Terms of Service

Welcome to The Virtual Photo Booth ("we", "us", "our"). By accessing or using our website, applications, or services (collectively, the "Service"), you ("you" or "User") agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

1. Eligibility & Accounts

You must be at least 16 years old to create an account. You are responsible for maintaining the confidentiality of your account credentials (including any booth PIN you create) and for all activity that occurs under your account.

2. The Service

The Service provides virtual photo booth experiences, including photo capture, templates, gallery hosting, and email delivery of photos to event guests. We may modify, suspend, or discontinue features at any time.

3. User Content

You retain ownership of photos, designs, event details, and other content you submit ("User Content"). You grant us a worldwide, non-exclusive, royalty-free license to host, store, process, display, and transmit User Content solely to operate and improve the Service. You represent that you have all rights necessary to upload and share User Content and that it does not violate any law or third-party right.

4. Guest Photos & Email Delivery

When you operate an event, guests may provide their email addresses to receive their photos. You are the data controller for guest contact information; we process it as your processor solely to deliver photos and provide the Service. You must have a lawful basis to collect and share guest contact information with us.

5. Acceptable Use

• No illegal, harassing, hateful, deceptive, or infringing content.
• No nudity or sexually explicit material involving minors. No CSAM, ever.
• No attempts to break, scrape, reverse engineer, or overload the Service.
• No use of the Service to send spam or unsolicited marketing emails.

6. Payments & Refunds

Event packages are billed as one-time purchases at the time of booking. You may request a full refund at any time before your event by emailing info@360djs.net. After your event has started, fees are non-refundable except where required by law. Prices may change with reasonable notice; existing bookings keep the price paid.

7. Termination

You may stop using the Service at any time. We may suspend or terminate your access for violation of these Terms or applicable law. Upon termination, your right to use the Service ends; certain provisions survive (IP, disclaimers, limitations, indemnity).

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUES. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR USD $100 IF YOU HAVE NOT PAID US.

10. Indemnification

You agree to indemnify and hold us harmless from claims arising out of your User Content, your events, your violation of these Terms, or your violation of any law or third-party right.

11. Changes to the Terms

We may update these Terms from time to time. Material changes will be announced via the Service or by email. Continued use after changes constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of the jurisdiction in which we operate, without regard to conflict of laws principles. Disputes will be resolved in the competent courts of that jurisdiction.
